
You may meet with limited success, or no success, dependent on the circumstances, if you pursue a remedy utilizing this avenue. However, it is my understanding that they (Dept of Labor)will be very selective in what complaints they will process, or litigate.
In consultation with a representative of the Regional Department of Labor, DOL will look at the severity of the violation, how it affected the individual, and what type of remedies, or what type of action, ie., administrative v. litigation, and the cost effectiveness of the appropriate action. In that respect, I don't believe DOL will initiate a complete investigation unless it does involve a serious violation, ie., termination, direct violation of prohibited acts, etc.
